SECTION 23 IPC - Indian Penal Code - "Wrongful gain"
According to section 23 of Indian penal code, ?Wrongful gain?: Wrongful gain is gain by unlawful means of property to which the person gaining is not legally entitled.
?Wrongful loss?: Wrongful loss is the loss by unlawful means of property to which the person losing it is legally entitled.
?Gaining wrongfully?: A person is said to gain wrongfully when such person retains wrongfully, as well as when such person acquires wrongfully.
?Losing wrongfully?: A person is said to lose wrongfully when such person is wrongfully kept out of any property, as well as when such person is wrongfully deprived of property.
भारतीय दंड संहिता की धारा 23 के अनुसार, सदोष अभिलाभ - सदोष अभिलाभ विधिविरुद्ध साधनों द्वारा ऐसी सम्पत्ति का अभिलाभ है,
जिसे प्राप्त करने वाला व्यक्ति वैध रूप से उसका हकदार न हो।
सदोष हानि - सदोष हानि विधिविरुद्ध साधनों द्वारा ऐसी सम्पत्ति की हानि है, जिस हानि को उठाने वाला व्यक्ति वैध रूप से उसका हकदार हो।
सदोष अभिलाभ प्राप्त करना - जब कोई व्यक्ति सदोष लाभ रखे रखता है और सदोष लाभ अर्जित करता है तो उस व्यक्ति द्वारा सदोष अभिलाभ प्राप्त करना कहा जाता है।
सदोष हानि उठाना- जब किसी व्यक्ति को किसी सम्पत्ति से सदोष अलग रखा जाता है और सदोष वंचित किया जाता है तो उस व्यक्ति द्वारा सदोष हानि उठाना कहा जाता है।
